Definitions

• The website at http://thestartuptoolkit.com ("Service")
• The owners & operators of the Service ("We", "Us", "Our")
• Anything you type in or upload to the Service ("Your Data")

Public (no account) scratchpad data

Public scratchpads can be made in two ways. The first is to create a new demo canvas before you have an account (or while you're logged out). Since you haven't entered a username and password, we can't protect its privacy (although it is hard to find because of the random website URL). The second way is if you change the privacy settings of a canvas to public in your dashboard. You'll know a canvas is public when it has a big unlocked icon next to its name

• Anything you type into the free scratchpad canvas is available to anyone who has the correct URL.
• We will never share the URLs to your scratchpads, nor will we share any of the data you enter on them (but someone who gets the correct URL will have free reign to view & change what's there).
• Anything you type into canvases while logged in to a registered account is private and only available to you and those whom you have given access permissions to, unless you explicitly choose to make it public.

Private canvas data (via registered accounts)

• Your data is yours. We can't use it, analyze it, or share it beyond what is required for us to run the Service (which is basically just blindly keeping it in our database), unless you explicitly say otherwise.
• If you explicitly choose to make your Data public (such as choosing to share it as a public case study), then it's available for any kind of use, by anyone, including us.
• You can permanently delete your account and all associated Data by emailing robftz@gmail.com. Your Data will be removed from the live site & databases within two working days. It will continue to exist in backups for no more than 30 days, after which time every trace of it is gone forever.
• Your Data is backed up daily to multiple locations. In the event of catastrophic Service failure, you should lose less than 36 hours data.
• If we cancel your account for any reason that is outside your control, we will send a copy of your Data to the email you signed up with.

Your account & use of the Service

• If we feel you are using the service to break any law or are abusing the service, we may disable your account and canvases.
• The service is provided "as-is" and you use it at your own risk
• Sometimes the site will be down or unavailable. We aren't responsible for any damage caused by the site failing.
• You may cancel your account at any time by emailing robftz@gmail.com

Hey, it's you!

• You are at least 13 years old.
• You signed up with a valid email which you have access to.
• You are responsible for maintaining the privacy & security of your login credentials.
• You are responsible for whatever happens on the Service under your account.
• You won't use the service for illegal or inappropriate purposes, including (but not limited to!) posting content that violates copyright or IP laws or contains another company's trade secrets.

Meta

• We're allowed to change these terms. If we do so, we'll make a blog post about it and post the latest version at http://thestartuptoolkit.com/terms. By using the site, you agree to the current terms of service.
• Violation of the terms will lead to the cancellation of your account
• You expressly understand and agree that We shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, trade secrets, data or other intangible losses (even if We has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
• Our failure to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Us and govern your use of the Service, superceding any prior agreements between you and Us (including, but not limited to, any prior versions of the Terms of Service).
